Malaysia Work Permit | DP10 visa Malaysia

Professional Work Permit,  Employment Pass, DP10 Visa

Company Registration in Malaysia and Malaysian Work Permit or to apply DP10 Visa Malaysia has become more simply now.
newnewFrom 15th April, 2014 Malaysian Immigration has introduced ONLINE DP10 Work Permit Application System. No need to hire any “Flying Agent“. Now you can apply Malaysian Work Permit Online. Just you need to have a Company with at least RM1 million PAID UP CAPITAL (for all lawful business activities), a physical office with fixed phone line and Signboard permission (PBT). Malaysian Immigration Department always encourage Foreigner Investors who want to contribute in Malaysian economy. But if register your company through such “Company Secretary” who does not know the immigration procedures and adds such activities in your company’s Memorandum which require many licenses BEFORE applying work permit and if you apply your Work Permit without getting the licenses as per your company’s activities, then your Work Permit application can be REJECTED and your such company may become a “Total Loss” for you!. SO, always consult with professionals who understand Immigration procedures MORE than Company Registration matters!

What is a Malaysian Professional Work Permit Visa or DP10 Visa?

Many foreigners, specially from India, Bangladesh, Iran and Pakistan come to Malaysia to start their business. But most of them cannot find the right person or company to assist them to get their Work Permit done in the time limit. Most of them meet the “Flying Agents” who meet the clients in “Restaurants” and offer the clients very attractive prices for new company registration in Malaysia. Even such “Flying Agents” don’t have any office or any license and they take the money from innocent Foreigners and disappear!. We always advise Foreigners to be very careful about such “Flying Agents” who don’t have any office or any license. Even most of such “Flying Agents” don’t have legal visa to stay in Malaysia. They come to Malaysia on visit visa and become agents to cheat innocent Foreigners.Normally the easy target of these “Flying Agents” are those innocent foreigners who come from their own home country and they speak their own country language.Remember: Sole proprietor,  Ready Made or Shelf Company and a Company with only Authorized Capital is NOT entitled for “Work Permits”.With a recent change in Immigration rules, the expatriates working in Malaysia for 3 years can also apply for a Permanent Residency.

To be saved from “Flying Agents”, BEFORE you hire any one’s services in Malaysia, necessary to check:
Ask the person/company to show whether they are licensed Company Secretary or not! You can check this from any company which they have incorporated before. Ask them to show the documents of any company which they have incorporated before this..and then see what is written on {Documents Lodged By:} a space provided on bottom of Form24 or Form49 of EVERY COMPANY in Malaysia. If there, you find their company name (the company who is claiming you that they can register your company with paid up capital) go ahead BUT if you don’t find their company name on this space {Documents Lodged By:} It means the person/company you are dealing is just a “Middleman” company or “Flying Agent”!
Furthermore; According to Government of Malaysia’s rules, ONLY Malaysian citizen can be the “Company Secretary” so if you are dealing with any “Foreigner” (may be from your own home country) then it means you are dealing with an “AGENT”…not with a “Company Secretary” of a “Company Secretarial Company”. Be careful to be the victim! Contact your embassy in Kuala Lumpur and ask how many people from your country have become the victim of such “Agents” who normally belong to client’s own home country.

FAQ’S

Can I register my own Company in Malaysia?

Yes, now you have an opportunity to register your own company in Malaysia. Legally, without any “Local Malaysian Director”, simply saying a “100% Foreign Owned Company”!. But the minimum paid up capital (CASH) MUST be RM 500,000 on which you may apply your director visa. This detail appears on Section “D” of Form 24 of SSM Forms. But have in mind that It must be clearly written that RM500,000 is “FULLY PAID Up or ISSUED. Cheaters just show RM 500,000 in the “AUTHORIZED Capital” column which DOES NOT means that it is CASH and fully paid up.

What is a Professional Work Permit Visa?

Professional Work Permit is an Employment Pass for 2 years (DP10 Visa). Professional Work Permit is issued to Top Level Management ( Company Directors, Managers ) and Highly skilled professionals. It means that an expatriate from another country is a one of the company director/shareholder or Highly Skilled and is Offered a Top level position/Skilled Job in Malaysia. The skilled categories are the same as in Western Countries – IT Professionals, Teachers, Doctors, Nursing and Managers. In simple words it is an ‘Employment Pass’ issued by the Government for Employees of a Company. The initial validity of the pass is 2 years but it can be extended for 10 years.

A Company (Sdn. Bhd. i.e. Private Limited) needs to have a “CASH” Paid Up capital minimum RM 500,000/- to qualify for recruiting Foreign Staff including Work Permits for company Directors.

This Employment Pass has a High Value in the International Arena. Those individuals seeking to apply for Canadian, Australian, UK and USA Immigration/work permits have a higher probability of success once they qualify for the Malaysian Professional Work Permit. Malaysian Companies are recognized all over the World. This means that their Work Experience is recognized internationally. For example Australia issues a 3 months visa for a Working Individual in Malaysia to explore and find a job there. Many Malaysian Companies have branches in Western and Far East Countries, therefore an employee can request for a transfer to another branch in USA, UK, Canada or Australia. This widens the horizons for an individual who in the long run is planning to settle in the West and working in Malaysia for the short run.

What is an Expatriate Visa, Director visa or DP10 visa?

Expatriate Visa, Director visa or the DP10 visa, all are the same and commonly used names “Employment Pass, Professional Work Permit or Professional Pass”. An Expatriate has a better potential of securing a better job career as compared to a General Worker.

To be eligible for work permits, company’s capital should be Fully Paid up and must be stated on Section “D” of FORM 24 (minimum RM500,000 for 100% foreign owned companies). QADKAM may assist you to register a company with RM 500,000 paid up capital within 5-7 working days. Once your company is registered with RM 500,000 Cash Paid up capital, then you may apply your professional work permit.

    • Hafiz Syed Amjad Hussain>> If many agents have cheated you it is BECAUSE you did not follow the easiest procedure. Who asked to contact “Flying Agents”? We always advise the foreigners to be careful from “Flying Agents” who may be from your own home country! Who may speak your own language!

Always consult with professionals. Applying Work Permit is very simple. The procedure is as follows:
1.Register Company with atleast RM1 million CASH paid up capital (QADKAM may help you to register such company in just 3 to 5 days)
2.Arrange physical office (you can get office on rent very easily through QADKAM real estate agent..the rental may vary from RM500 to onward)
3.Install phone line (QADKAM staff may assist you in filling up TM forms FREE of Cost)
4.Apply local council license (QADKAM staff may assist you in this regard if your office is located in MPAJ area..or QADKAM staff may assist you in filling up necessary form FREE of charge and may guide you how to get the local council license in just one week.)
5.When all these documents are ready, QADKAM lawyer ( member of Malaysian Bar Council) will be preparing your work permit application FREE of charge.
Immigration Department decides on application just in 7 days. You can track your work permit application status ONLINE on Immigration Department website.

The above procedure is very simple. And you will be having your genuine and own business with a legal work permit….But you don’t follow the immigration laws, you will lose your time and money and then will be back to your home country!

    • Kashif>>Registering company becomes total LOSS if it is registered by a such company secretary who does not know about Immigration Laws. Such ignorant Company Secretary may add such activities (import/export/manufacturing/restaurant etc…) which need WRT license prior to apply work permit…so you may lose your money even after having a company. So..to apply work permit, you should have a such company which has very simple activities which does not require WRT licence or you should have a local Malaysian citizen partner with 50% share to get exemption from WRT license. Furthermore, you MUST have a physical office with telephone line and a business permission from the local Council of the area where your office is located. If you have all these ready then your work permit application is very simple. QADKAM professional lawyer ( member of Malaysian Bar Council) will be preparing your work permit application FREE of charge if you register your company through QADKAM.

    • riaz>> Work Permits are always issued to Employees or to the management of the company. If you buy work permit from any “Flying Agent” you will be in trouble whenever you are caught by the immigration. The best way is; you find a job and then so..your employer will apply your DP10 visa (Employment Pass). OR you register your company and apply your DP10 visa as “Company Director/Shareholder”. We know many people who happily Bought Visa through “Flying Agents” and now are helpless in Sungai Besi Jail. Contact Pakistani embassy in Kuala Lumpur and ask them how many Pakistanis are in Jail just because of these “Flying Agents”..
If you have experience of business, the best way is; incorporate your company in Malaysia and then apply your DP10 visa as a “Company Director”. QADKAM may assist you in registering your company with paid up capital.

    Hello,

My wife and I are European and I work in Kuala Lumpur as a Director in foreign company. I have a work visa while my wife has a spouse visa. My wife would like to work as self employed person in a MLM (network marketing) company. I am wondering if it’s legal or if there’s anything she needs to do before starting this business in Malaysia.

Thank you and I look forward to your reply,
    Regards,
    Gianluca

    • Gianluca>> Normally, when you are not engaged in formal business/employment, you don’t need to apply work permit. But if the job is formal (you have to get paid and are working as normal incumbent) then your wife must apply permission from Immigration Department. This permission is granted FREE of charge to Dependent Pass holders. But if your wife will be working freely without any specific restrictions and does not hold any position in the company/office, then no need to go for permission. For further information, you can contact Immigration Office “Executive Lounge” at Putra Jaya.

    Reply

    • anwarul azim>> If you don’t have company then should have a job offer from company and you cannot apply DP10 visa at your own. Only the company can apply DP10 visa. Becareful from “Flying Agents”. Never try to buy work permits.

Work Permits are always issued to “Employees” or to the “Management” of the company. But if you BUY work permit from any agent, it may drag you in trouble. because, every Work Permit sticker has the “Employer/Company name” , “Address” and “Designation”. Just imagine…if immigration police stop you on any check point and immigration officer asks your visa status. Definitely, you will show him your passport. What if the police/immigration officer ask you to call your employer and ask your employer to come and take you from police station. Do you believe.. your “Employer” will know/recognize) you? OR he will come to police station to take you? I assume nobody will be coming to police station to take you from police custody. Employer will never come because you bought the work permit through “Flying Agent”…you were NOT a genuine employee so the employer will never confirm your employment status even no employer can confirm your status because to confirm, he will be required to show your salary slips, tax deduction etc…So such situation will result in detention in jail followed by the Deportation back to your home country. It means that such Work Permit are valid only until you are not caught by the immigration. And when you are caught, such Work Permits are remain just a useless stickers! May be you can come and go out of Malaysia by using such work permits, but once caught and any immigration officer wants to confirm your employment status, then you will be in trouble!

Even, in these days there many “Flying Agents” who offer “Professional Work Permits” as “Company Director”. These work permits are more dangerous. Because Flying Agents get such work permits by showing you a Director/Shareholder in a Malaysian company. Most of the cases, you will never know that in which company you are “Director/Shareholder” and what business your company is doing? And just imagine…You buy such work permit and start staying in Malaysia and then…one day, you are coming very happily back to your home country and you go to Kuala Lumpur International Airport to take flight to go back to your home country. When you reach Immigration counter and present your passport to the officer…suddenly officer inform you that “Hello Mr…YOU ARE A DIRECTOR OF A COMPANY WHICH HAS GONE BANKRUPT OR HAS DONE SOME FRAUD…SO YOU CANNOT GO BACK TO YOUR HOME COUNTRY WITHOUT POLICE INVESTIGATIONS OR PAYBACK THE BANK LOAN WHICH YOUR COMPANY HAS TAKEN AND NOW UNABLE TO PAYBACK” Because, according to SSM ACT 1965, you are equally responsible for your company’s dealing if you are Director of a company.

So, please be careful from “Flying Agents” who offer such permits just for money. They never think that what will be happening to innocent foreigner. One more thing…most of the ‘Flying Agents’ always cheat the people who are from their own home country.

So the best way to get Malaysian Work Permit is; find a job and then your employer will apply your work permit. OR register your own company in Malaysia and apply work permit as Company Director. If you want to register your company in Malaysia, QADKAM Sdn Bhd may assist you to apply Work Permit as Company Director.
      Cheers!

    HI,
    just a quick enquiry.
i oledi registedred a company with paid up capital 350k joint venture with both malaysian and foreigner.
I would like to apply director pass as i m the shareholder of this company as wel as executive director.
What is hte procedures that i need to do..?? or i just directly go to immigration centre..??
Waht is the neccesery documents that i hv to provide or preprare b4 i go there..??

    Reply

    • lin>> First of all, Immigration has already changed it’s criteria for issuing Employment Pass for Foreigner Directors/Shareholders. Now, what so ever your company’s Paid Up capital is…but the Foreigner’s Director/Share holder MUST has minimum RM500,000 share. So, you CANNOT apply Work Permit unless your individual share in the company is minimum RM500,000.
For professional Immigration file preparation, you may contact QADKAM Sdn Bhd, Malaysia office during normal business hours (Monday to Friday 9:00am to 6:00pm).

      • I understand.. But that one is for 100% own company.. However I m not 100% own that company. If the government changed it criteria, how come the web page of immigration don even mention that??

      • Lin>>

Then plz go to Immigration department and let them know that this blog has more updated information! Cheers!

In the last, Can I apply online through your website and tell me the mode of payments and total expense required.

    Reply

    • Wahaj>> One of our consultants has already replied you, please check your inbox. Now..regarding the offer of DP10 work permit by a “Consultant” in your country. Please read the following carefully:

      Cheers!

    • bobby>> Please arrange an appointment with any QADKAM professional by calling office (0060392875120) during normal business hours (Monday to Friday 9:00am to 5:pm) and discuss.
If you are married to a local, for your own work permit, you don’t need to incorporate a company with RM500,000 with paid up capital. Instead you can apply Spouse Visa. But for hiring foreigner workers, you need to incorporate a company with RM500,000 or more (we recommend RM1 Million) paid up capital. But please have in mind, for General Worker Category workers, you need to get approval from Ministry of Labour and Ministry of Home Affairs (MOHA). Your business MUST be genuine and the need of foreign worker MUST be genuine. Physical verification from ministry will be done BEFORE giving you approval.

Is there any type of independent visa by which he can choose his preferred work? Frankly to say, i want to bring him for my own business, instead setting up a company.

    Reply

    • Manmohan>>The best way is, you find the good/suitable job according to your portfolio. Once you get the job, your employer will apply work permit for you. But finding a suitable job with work permit is not so easy. The 2nd option is; Register your own company in Malaysia and work permit as Company Director. Such work permits are called “Professional Pass”. On such work permit, you can even bring your wife, children and parents.
To register a company, you can contact QADKAM Sdn Bhd directly. Don’t waste your time in searching “Flying Agents”. The “Flying Agents” are useless. Now Immigration department has tightened the Work Permit process. Such “Flying Agents” may cheat you by making very attractive promises. Always consult with licensed professionals. QADKAM Sdn Bhd is one of the leading Malaysian relocation company having clients from all over the world.

    • bharath>> Work Permits are always issued to “Employees” or “Management” (Directors/Shareholders, Managers, Top level Professionals) of the company. You must get a job offer from any Malaysian company and then your employer will get your work permit from Immigration Department OR you simply register your own company in Malaysia and apply your work permit as “Company Director”. QADKAM Sdn Bhd may assist you in getting your work permit as a company Director. Your details have already been forwarded to QADKAM Sdn Bhd professionals. Soon you will receive a response from them. But please NEVER BUY your work permit from “Flying Agents”. Because if you buy your work permits you will will not have any information that who is the owner of that company from which the “Flying Agent” has obtained your work permit, so if Immigration catch you definitely they will ask you to call your employer to come and verify your employment credentials but in such situations where police or immigration has caught the person, no one will be coming behind you in police station. So…you will be deported back to your country….That’s why we always discourage the foreigners to “BUY” the work permits. Always apply the work permit through legal and proper channel. The best and easiest way is..register your company in Malaysia and get your work permit as company Director OR otherwise find a job and ask your employer to apply your work permit (which is very Difficult but not impossible).

No, RM5000 salary compulsion is only for those who come under “Professional Pass” (High Category work permits which are granted to Management of the company or work permits granted to highly skilled expatriates). But if your job is not as I have described, then you would be considered only “General Worker”. And work permit for “General Worker”, there is no minimum salary set by Immigration Department.
